PRIVACY POLICY - Information document article 13 EU Reg. 2016/679 - GDPR - Information for the processing of personal data collected from the interested party

In compliance with the provisions of EU Regulation 2016/679 (European Regulation for the protection of personal data, we provide you with the necessary information regarding the processing of the personal data provided. The information is not to be considered valid for other websites that may be consulted via links present on the websites in the domain of the owner, who is not to be considered in any way responsible for the websites of third parties.

This information is provided pursuant to art. 13 of EU Reg. 2016/679 (European Regulation for the protection of personal data) and is also inspired by the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC on Cookies as well as the provisions by the Provision of the Guarantor Authority for the protection of personal data of 05.08.2014 regarding cookies.

Processable personal data: «personal data»: any information relating to an identified or identifiable natural person («data subject»); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more elements characteristic of his physical identity, physiological, genetic, psychological, economic, cultural or social; (C26, C27, C30).

1. DATA CONTROLLER, pursuant to articles. 4 and 24 of EU Reg. 2016/679, is GIADA S.r.l., Viale Risorgimento N.56, 45011, Adria (RO), Italy, VAT number 00822110292, C.F. 01313840249, e-mail address privacy@giadafc.it in the person of the legal representative pro tempore.

2. PURPOSE AND LEGAL BASIS OF THE PROCESSING

To access the Site it is not necessary to register. However, there are sections within the Site that require registration or the use of a username and password, or services for the use of which it is necessary to provide personal data (e.g. user data may be required to access the Newsletter services, for the purchase of the product in the e-commerce area).

The personal data provided will be processed in compliance with the conditions of lawfulness pursuant to art. 6 of EU Reg. 2016/679, for the following purposes:

- navigation on this website - legitimate interest (art. 6 paragraph 1 letter f)) as the legal basis for the processing;

- to respond to specific requests for information received via telephone calls to the numbers in the contact us area of the site;

- allow registration on the site and allow you to proceed with the purchase of products, fulfill the obligations and exercise the rights deriving from the concluded contract; (iii) fulfill the obligations of law, regulation and community legislation on the subject fiscal or accounting (invoicing, bookkeeping and accounting records);

- e-commerce and related administrative-accounting activities. Processing necessary in the context of a contract or for the purpose of concluding a contract and related administrative, accounting and pre-contractual activities. To provide the relevant services as provided for in the relevant contractual conditions and to allow the carrying out of all activities relating to the execution of the contractual agreement and fulfill the related services and obligations; art. 6 lett. b) GDPR: the processing is necessary for the pursuit of the execution of a contract of which the interested party is a party (e-commerce);

- subject to consent for direct marketing activities: if the interested party fills in dedicated forms for data collection, in specific areas for direct marketing purposes: subject to consent and until opposition for direct marketing activities of the Data Controller, sending of newsletters and promotional, commercial and advertising material or relating to events and initiatives, abandoned cart reminders, by the Owner through automated means of e-mail, fax, SMS or other types of messages, as well as through telephone calls via operator, including automated ones, and by post paper and other information material. Legal basis: Consent art. 6 par. 1 letter a): the interested party has expressed consent to the processing of their personal data.

If GIADA S.r.l. acquires information and personal data will inform users in advance, pursuant to art. 13 of the Regulation, of the purposes for which such data are requested and the ways in which they will be used. Where necessary, GIADA S.r.l. will acquire the user's specific consent to the related use of the data. By way of example, personal data may be requested such as name and surname, telephone number, e-mail address, billing and shipping address and other information that the user agrees to provide to use the Site's services through completing a specific registration form. GIADA S.r.l. will use the personal data collected online for the sole purposes indicated during registration.

3. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE DATA
The personal data provided will be communicated to recipients, who will process the data as managers (art. 28 of EU Reg. 2016/679) and/or as natural persons acting under the authority of the Data Controller and the Manager (art. 29 of EU Reg. 2016/679), for the purposes listed above in point 2. Precisely, the data will be communicated to: - subjects who provide services for the management of the information system used by GIADA S.r.l. and telecommunications networks; - freelancers, studios or companies in the context of assistance and consultancy relationships; - subjects who provide services for the management of the information system used and telecommunications networks, including email, newsletters and website management; - third parties who collaborate with the Data Controller for direct marketing activities; - competent authorities for compliance with legal obligations and/or provisions of public bodies, upon request. The subjects belonging to the aforementioned categories perform the function of Data Processor, or operate in total autonomy as separate Data Controllers. The list of Data Processors is constantly updated and available by writing to privacy@giadafc.it.

4.DATA CONSERVATION PERIOD OR CRITERIA FOR DETERMINING THE PERIOD
The processing will be carried out in an automated and manual manner, with methods and tools aimed at guaranteeing maximum security and confidentiality, by persons specifically appointed for this purpose.
In compliance with the provisions of the art. 5 paragraph 1 letter. e) of EU Reg. 2016/679, the personal data collected will be stored in a form that allows the identification of the interested parties for a period of time not exceeding the achievement of the purposes for which the personal data are processed. The storage of personal data provided depends on the purpose of the processing:
- browsing on this website (1 year); - receiving newsletters or promotional communications generally via e-mail (until you object (opt-out/withdrawal of consent), e-commerce (24 months); timing determined on the basis of criteria of which the interested party can obtain information by writing to privacy@giadafc.it at the registered office of the Data Controller.

5. NATURE OF THE PROVISION AND REFUSAL

Apart from what is specified for navigation data, the user is free to provide personal data. The provision of data is optional or necessary depending on the specific purpose for which the data is processed. Failure to provide the data marked with the symbol* will make it impossible to obtain what is requested or to use the services of the data controller.

6. RIGHTS OF INTERESTED PARTIES

You will be able to assert your rights as expressed in the articles. 15, 16, 17, 18, 19, 20, 21, 22 of EU Regulation 2016/679, by contacting the Data Controller, or the Data Controller, by contacting privacy@giadafc.it You have the right, at any time, to ask the Data Controller for access to your personal data, rectification, cancellation of the same, limitation of processing. Furthermore, you have the right to object, at any time, to the processing of your data (including automated processing, e.g. profiling), as well as to the portability of your data. To no longer receive automated direct marketing communications (e.g. e-mails, text messages), simply use our automatic cancellation systems provided for e-mails only. To no longer receive traditional direct marketing communications (telephone calls with operator and paper mail), simply write an e-mail at any time to privacy@giadafc.it with the subject "unsubscribe from traditional". Without prejudice to any other administrative and jurisdictional appeal, if you believe that the processing of data concerning you violates the provisions of EU Reg. 2016/679, pursuant to art. 15 letter f) of the aforementioned EU Reg. 2016/679, you have the right to lodge a complaint with the Guarantor for the protection of personal data and, with reference to the art. 6 paragraph 1, letter a) and art. 9, paragraph 2, letter a), has the right to revoke the consent given at any time. In the event of a request for data portability, the Data Controller will provide you in a structured, commonly used and readable format, by automatic device, the personal data concerning you, without prejudice to paragraphs 3 and 4 of the art. 20 of EU Reg. 2016/679.
